The whole buying process can be broken down into five important stages. In this material, we will briefly describe them so that you can immediately imagine the procedure for registering real estate in ownership.
The first step is to sign a sales contract.
The contract will prescribe the data of both parties, their rights and obligations, as well as the characteristics of the property you are buying. The contract is drawn up in a language that you know well. All you need is your international passport.
When signing the contract, the buyer pays a deposit. The amount of the deposit will also be fixed in the contract.
Both parties sign 2 copies. You can also sign the contract online: documents executed remotely are protected by Turkish law and do not differ legally from those signed in the personal presence of the buyer.
The second step is to prepare all the documents
In order to be able to issue a certificate of ownership, you need to gather some additional documents. The list is roughly as follows:
- Certificate of an independent examination (we invite an appraiser who will calculate the cadastral value of housing)
- A document confirming the exchange of currency for Turkish Lira (we receive it from the bank after opening an account and transferring money for payment to your Turkish account)
- Turkish TIN (issued in 2 minutes online or in Turkish tax)
In addition, you can issue a power of attorney for us – so you will not have to be present in Turkey at the cadastral department to register the deal. We will be able to make all the documents without your personal presence.
The third step is the payment of real estate
Usually, the buyer transfers money by SWIFT transfer from his account to the account of the developer or owner according to the details. But there are other payment methods as well.
The fourth step is to obtain a certificate of ownership
The most important of all stages begins with an application on the website of the cadastral administration. You will be given a date and time for your appointment. On this day, you must come to the cadastral department along with an accredited sworn translator (without his presence, a foreigner cannot conclude a deal in Turkey).
After full registration in the Land Registry you will receive a certificate of ownership of the property. In Turkey, this document is called TAPU.
It is very important to choose a reliable real estate agency so that the realtors thoroughly check all the documents and you would get a TAPU without any difficulties. The fifth step is the post-sale paperwork.
After receiving the TAPU, you issue utility meters (water and electricity) in your name. It’s a pretty simple procedure.
Before that, if you are the first homeowner, you should get another important document along with a certificate of ownership. We are talking about a technical passport for real estate. In Turkish it is called ISKAN.
Some advice for everyone who wants to buy an apartment in Turkey
- Study the city you are interested in, at least in general terms, according to the descriptions on the Internet: you may be attracted to areas that you have never heard of before.
- The technical passport for an apartment is no less important document than the certificate of ownership. Check before buying whether the developer has a technical passport for the built complexes.
- Don’t neglect the developing areas of the cities. If there is a lot of construction in the quarter, then very soon everything necessary for a foreigner will appear here: cafes of national cuisine, chic beauty salons, home delivery of food, private kindergartens for children and much more.
